Las Vegas ATV Adventures – Terms and Conditions
Please read these terms and conditions carefully. You must not make any booking unless you understand and agree with the following terms and conditions. References to “us,” “we,” and/or “our” in these booking terms and conditions shall mean Las Vegas ATV Adventures. These terms and conditions apply to bookings made with us (online, over the phone, or by email) as well as online bookings on our website. These terms and conditions, in addition to our privacy policy and any other written information provided to you before your booking, constitute our contract with you. By making a booking, you represent that you are over 18 years of age.
We will rely on the authority of the person making the booking to act on behalf of any other traveler on the booking, and that person will bind all travelers to these terms and conditions.
Booking Conditions
Las Vegas ATV Adventures is a Tour Booking Agent. We work with partners, referred to as the “Operator,” “Tour Operator,” or “Supplier,” to offer the best experience, customer service, and fair pricing for the services we offer. We endeavor to ensure that all our clients have complete satisfaction. It should be understood, however, that we act solely on behalf of the Supplier providing the specified travel product, and all bookings are accepted on the following conditions.
Liability
All referrals by us are subject to the terms and conditions of the operator concerned. We have no direct contractual liability to you in connection with the travel product specified, except as may be imposed by law. As a referral service, we accept no responsibility for the acts or omissions of the travel supplier or operator. The Operator’s terms & conditions will apply to your booking, and we advise you to read these carefully as they contain important information about your booking. Please ask us for copies if you do not have them.
Assumption of Risk
Guests acknowledge that the enjoyment and excitement of ATV adventure travel derive in part from the inherent risks associated with off-road activities. Therefore, by booking, you acknowledge and accept the risks of participating in Las Vegas ATV Adventures tours, which include but are not limited to:
Injury or death from vehicle operation or collisions with other vehicles or natural obstacles.
Risks due to rough terrain, steep inclines, rocks, loose gravel, dust, debris, and weather conditions.
Exposure to the elements, including extreme heat, sun, cold, rain, wind, and wildlife.
Equipment failure or malfunction of ATVs or safety equipment.
Potential fatigue or physical exhaustion from operating an ATV.
You accept these risks and freely assume personal responsibility for any injury, illness, or death that may occur due to these hazards, even if unanticipated.
Release
Las Vegas ATV Adventures (“released party”) shall not be responsible or liable for cancellations, actions of Local Tour Operators or other service providers, variations, delays, or omissions due to actions by transportation companies, or changes in services. Nor shall Las Vegas ATV Adventures be liable for loss or damage to baggage, injury, illness, or death, nor for any claims arising from acts or negligence not caused by Las Vegas ATV Adventures, including the actions or omissions of government authorities, employees, or third-party service providers.
Additional Risks
Las Vegas ATV Adventures does not own or operate ATVs or any related equipment. All Operators are independent contractors, not employees or agents of Las Vegas ATV Adventures. Las Vegas ATV Adventures assumes no liability for delays, schedule changes, losses, injuries, or damages. You acknowledge that by booking, you accept the Operator’s terms and are bound by them.
Payment
Payment is required upon booking your tour. All Booking Requests must be submitted with a major credit card unless otherwise expressly stated and are subject to additional fees. Charges include the price of the booking plus service fees, which cover credit card processing, fuel surcharges, and booking costs. Service fees are non-refundable.
For group bookings, a 50% deposit may be required. Final payment for groups is due 7 days prior to the tour. Online payments are processed securely, and you authorize us to charge fees to your designated credit or debit card. If the card issuer does not process payment, you agree to pay us immediately upon demand.
Cancellation and Amendments to Your Booking
Individual Bookings
Cancellations and amendments are accepted if we are notified at least two days before the booking. Cancellations within 48 hours may incur fees up to 100% of the booking at our discretion. Refunds for canceled bookings are not processed until funds are returned by the supplier.
Group Bookings
Groups of six or more must cancel or amend bookings at least 7 days in advance. Within 7 days, fees up to 100% may apply. Refunds for group bookings will be processed only after receiving funds from the operator.
Refunds are made by the original payment method. Re-booking fees of $20 per ticket apply for reinstated reservations. For same-day bookings, cancellations may incur up to 100% charges.
Changes and Cancellations by the Operator
Las Vegas ATV Adventures or the Operator will inform you as soon as possible if changes or cancellations are necessary. While we will work to facilitate alternatives, we bear no further liability for these changes. Tours may be canceled due to weather, mechanical issues, traffic, or other factors.
Reminders and Late Arrivals
You are responsible for arriving at departure points on time. If departure points change, the Operator will contact you. We do not accept responsibility for late arrivals. No refunds or rescheduling are provided for late arrivals.
Health Requirements
Participation in ATV tours requires physical fitness and stamina. You are responsible for assessing your ability to participate safely. Restrictions apply for pregnant women, children under 48 inches tall, and individuals with neck or back injuries.
Complaints
If issues arise, please notify your tour operator’s representative immediately. Las Vegas ATV Adventures is not responsible for complaints about third-party services.
Video and Photography
Las Vegas ATV Adventures reserves the right to use photographs, videos, or audio recordings of participants for marketing purposes without notification or compensation.
Tour Policy
All ATV tours proceed rain or shine, and refunds are not issued for early returns due to weather. Safety rules prohibit smoking, illegal substances, and glass containers on tours.
Transportation Policy
Pickup locations vary; guests must be available within the pickup window. Tours may include an additional charge for transportation, and pickup is available only from designated areas.
Changes or cancellations in transportation are possible at our discretion.
Reservation & Refund Policy
Reservations within 48 hours are final. Service fees are non-refundable. Refunds for transport are adjusted based on the original retail price. Rescheduled tours become final and
non-refundable.
SMS Terms
Message frequency varies. To opt-out, text “STOP”. Standard message and data rates may apply.
Force Majeure
Las Vegas ATV Adventures is not liable for disruptions due to events outside its control, including natural disasters, strikes, wars, or government restrictions.
Choice of Law and Venue Selection
This agreement is governed by the laws of Nevada, with any disputes resolved therein.
Severability
If any clause is deemed illegal or unenforceable, the remainder of these terms shall remain valid.
